      Pay Pal

My brother sold his old wheel chair on e-bay and I sent it out for him. I sent it through the post office and asked the clerk if I needed any additional tracking and she said no, that it was trackable through the pkg # or through the insurance number. So off the package went. Well the kid that bought the wheel chair from my brother got the package and my brother got an e-mail from Pay Pal that said they were taking the money back out of his account, so my brother took all of the money out of the account, but Pay Pal gave him a negative balance of $450 (the price the kid paid for the chair).

So now Pay Pal is refusing to credit his account even though the kid got the pkg. Has anyone run into this sort of thing and what should I do? I am doing all of the leg work for my brother, calling the post office and that sort of thing.

Pay Pal said that the package was not trackable when it was shipped, so therefore they were taking the money back. Now I talked to the Post Office and they said that they can track the package, but not over the internet, but over there own system. The clerk that checked me out "didn't know". So I talked to the Post Master General and she said that she can give me copies of the original mailing receipt and copies of the receipt that the kid signed when he received the package. Does anyone have any kinda help?! I just don't want my brother to be out the chair and the $450! It just isn't right!

And people ask me why I refuse to use Paypal...

Sorry for the trouble.. ask the USPS is the package can be tracked.. If it can but you they didn't get a signature then you are screwed..

In this case go to the guys house and make him eat the chair..

If you have a signature (as it sounds) and you can get a copy then let Paypal know this and that if they do no give you the $450 you will take them to small claims court.

So I take it the buyer is pretending like he didn't get the goods??

Paypal is very bad!! they can do anything they want, as they are NOT federally insured and answer to no one...like Steve said if you have a signature you should be ok, fax a copy to paypal but dont give it up and keep it safe!!!, most people dont have that and lose the item and the money, your bro was lucky to get his money most of the time they snag it and send it back to the rip off artist and you get nothing and like it.

Paypal surely has sent you notices by email. Answer all of them and explain that the item was sent and received and you will get proof from the shipper. This will pause the investigation and give you time to collect all of your backup paperwork. Scan the paperwork and then email it to Paypal. I had to do this twice and Paypal sided with me once they received the proof.

Here is what will happen now. I warned of this exact scenario a couple months ago in this thread

      https://www.pro-touring.com/forum/showthread.php?t=4258

I copied and pasted here also:

Paypal IS NOT the answer. Did you know that buyers that use their credit card with Paypal have 90 days to dispute charges, and it you do not reply to the credit card companies satisfaction, the funds are removed from your account? I know, I am in a legal battle with Paypal now.
This is what happened, I sold $2000 of parts, 70 pieces to someone, old NOS stuff. We had talked about him buying for 2 months before he bought, and had enough conversations for him to know I travel out of the country a lot. When we did the deal, he called me and complained about a couple pieces, Said they were scratched. I had plenty of others so I told him to send back the ones he was complaining about. I explained I would be in the Jungle in Costa Rica for a couple weeks or so, and would exchange them when I got home.
He then returned the box with 3 of the 70 pieces. He then contacted his credit card company to dispute the charges, claimed he returned all 70 pieces. Paypal then emailed me and gave me 3 days to respond to the complaint. Of coarse at this time I am in the jungle, on generator power, no TV, no phone, and damn sure no Internet. He knew this would be the case as he expressed interest in my trip.
It is important to note here that I knew I would be taking this trip and had stopped running all auctions, and was sure that all buyers had their stuff before I left. This guy seemed like a nice guy and I really did not think anything of it.
Here is what happened, because I did not respond to Paypal in 3 days, (I could not accesses e mail) and because this guy had a tracking number showing I received a box from him, Paypal took his side, deducted the money from my Paypal account, and instead of having $1200 in Paypal, I was now negative $800!
When I returned home and found the e mails from Paypal, and the negative balance I contacted Paypal to see how this could happen. They explained the 90 day rule, and the 3 day response rule. I appealed and provided my passport showing I was in Costa Rica, my plane tickets each way, and explained there was no Internet. They explained that to prevent this, A SELLER MUST BE AVAILALBE FOR THE 90 DAYS TO CHECK E MAIL FOR DISPUTES. And if one is not available, they will lose!
Now they have turned it over to collection, and are threatening to put it on my credit. I told them to go F themselves and sue me.
It's ugly, but right now Paypal is out $800, and I am out $1200, and of coarse the piece of dung that bought the parts, that I always reached before, does not answer calls.
That is OK though. I am doing some recon work. We will get our money.
So long story short, your guy could easily dispute the sale. Also, this is extremely important, NEVER, NEVER send to an address besides the Paypal listed address because your only defense in a dispute is a tracking number to that address. If you cannot prove you sent to that address, you are automatically wrong and you lose.

      Another post on that thread:

Jabin, the problem is if the money is not in the Paypal account, they just put you negative and either try to take it from your bank account, or in my case try to charge my Visa card on file. If they cannot get it from one of those 2 sources, they send it to collection, and may be able to get it on your credit report as a collection which means sooner or later, they will get paid with interest, if you ever finance anything again.
I did something similar to your dumping it in the bank. Not on purpose, but at the time they deducted the funds, I had spent about $800 of those Paypal dollars with a Visa debit card for the Paypal account. They then put me negative the other $1200 and asked in e mail to be paid in so many days (21 I think but I would have to look it up) or they would charge the card on file. After realizing they were standing on the wrong side of the fence, I figured the best way to get them on my side of the fence was to make them an equal victim, so I reported that credit card on file as missing, lost, stolen, and had my credit card company issue a new card with a new number.
It was hilarious when they tried to charge that card after the so many days and it came back invalid. It was kind of funny, you cannot get live people on the phone with Paypal, but change that fugin card and watch the phone ring, LOL!
Long story short the stupid SOBs are still hounding me instead of the guy with all the stolen parts!
