i think she is worried about losing her ins coverage if there's a claim.
      too bad for her....
i just called her ins (progressive), she never reported the accident! i even told her (before i knew she was responsible) that she has to at least report it, otherwise the ins gets notified by the police of an incident and her rates go up. the really fun part is that she switched to geico a few days after the accident, and they're notorious for dropping people! especially with shady crap like this!
luckily the ins report still shows that she had the BS story, but states she recanted it "quickly". i'm not sure if this makes a difference, but it also shows she got a "written warning". i figure it's not as good as a ticket, but better than nothing.
i am feeling soooo much better about all of this now. and much more relaxed--partially because she did move out! no more drunken stupidity yah! lol
thanks to everyone for the advice! i do appreciate it.

Pretty good chances actually. BTW if you have full coverage your own insurance should cover any damage to your vehicle, full coverage should include uninsured motorist protection.

In California its illegal to drive a car without insurance at all, not sure about Florida though. I would sue her for destruction of property either way, the odds are in your favor.

You are now hopefully lucky enough to live in a state that has mandatory uninsured motorist coverage/ underinsured motorist coverage. Leaving only to deal with your insurance for it all.

Things always look the worst when you can still see the damage. When you finally get it all right and squared away you will hopefully look back and see that even if you paid more for an increase in your insurance that you will be able to look at your car and be thankful the insurance money and the other people who did the labor made it all look better than if you paid to get the work done to just make it look the way you wanted/new.

Everytime I have been in an accident and things were going bad like for you, I always ended up better in the long run and couldn't see it from where I was looking at the time.

Don't let up on your insurance company one bit. You paid to be covered make sure they take care of you.

unfortunately i only have liability. it does include un/underinsured, but that only covers bodily injury, not property.

That does suck, well then it looks like your only option is to sue her. It shouldn't be too hard since everything was clearly her fault.

      Good luck.
