need advice regarding ebay.com

Hey Guys, I know this is not a free law center...
But maybe some (or at least one) of you had similar experience and can tell me his/her opinion...

Since couple of weeks I'm looking for a specific item accross the internet.
And I found one by chance on ebay.com.

I purchased the item for $141.95 (excl. shipping). It was a "buy it now" auction.
The market value of the item is over $1100.00(!!!), so the seller put a wrong price in.
Now the seller won't ship it (I did pay already via VISA card) because he put "we are not resonsible for typographical errors" under their terms and conditions.



I want this item, because it's the sellers fault if he puts a wrong price tag on.

May anybody can help?

My gut feeling would be that they are absolutely responsible for anything they write. It does seem like they made a mistake and it would be reasonable to just ask for your money back.

This isn't the first time this has happened.

Just because someone puts something in writing doesn't exclude them from responsibility. It's like if you posted a sign in your yard that says trespassers are shot on site. You better believe if you shot someone in your yard you'd be facing charges.

I agree....pretty much just a mistake....they refund your money and its done...you'd hardly expect someone to eat $900 odd would you?

ask what are they willing to sell it to you for maybe you can still save money and get what you want.

They offerd a $25.00 discount. On an $1100.00 item... awesome.

I bought a motorcycle on Ebay one time under the same circumstances. I won a bike that was easily worth about $10K and got it for $6,500. When I talked with the seller he said he forgot to put a reserve on it and was very mad at himself but honored the auction.
It seems that this person isn't going to honor the auction and live with a mistake they made. I think the best thing you can do is contact Ebay's resolution center and put it in their hands. Getting your money back is the least you can do. Maybe Ebay can give them a bad mark if they don't want to work with you.

Well, the sad part is that's not a private seller. It's a Company with over 38000 trades.
So I expect that they act professional. Of course I get my money back.

if you look at the ebay policy it says that the auction is a contract between the buyer and seller. That means that he should give it to you at the listed price. unfortunately if he sends your money back there really isn't anything you can do. I had a very similar thing happen they sent my paypal money back... wich I lost the paypal fees over... and all you can really do is leave negative feedback with a good explanation.

Agreed there are lots of place to burry a body. "I'm sorry, but I meant times ten on the price" Push your luck as far as it will go. At some point you and the seller must realize it was an error on behalf of the seller and strike a deal. Playing the "but you said" game will get you no where in a hurry. At the same time do not let the seller bully you into pay full price for an item he/she posted at the wrong price. If you want the item and they want it sold then I see no problems getting what you and they want out of the sell. If one person is preying off the other then, well expect the expected.

You ll be luck in getting your money back. I had a auction at where I won the bid, sent the money and they didnt send the item. I reported them to the locals and reported it to eBay. Havent heard from any ever since them =/
