Got home today and this was on my front porch. The weird thing is it had my eBay ID on the outside of the box.

I will try to locate the company that sent it. Someone probably paid for it and is waiting for its arrival.

Ok, no packing slip. But the name on the box is White Performance, Kingsport TN. Now onto Ebay to see if they have a store!

This is what I found... I called and talked to a woman there and she had no record of this item being shipped to my address. She is going to check to see if there is another person in Crown Point IN that ordered this. I told her I would be happy to take it to them. She was going to call me back and let me know. I asked her about my Ebay ID an again she did not have any record of this either. Strange?

Anything dropped at or shipped to your address that you did not order is yours free of charge legally.

You can be a great guy and try to find out who ordered the part or to who is was really shipped. You can also keep the part with a clear conscience.

Well it looks like there is another Tim Watson , and on Sept 9 he ordered 2 items from this place one being one just like I have. But he received them all ready on the 15th of Sept. So she said they will send a recall tag and pick this up tomorrow between 8 am and 6 pm. She was also surprised that I called. I told her it was not mine and I did not order it. Now a call to Ebay!

I don't understand your rationalization on how you can keep something they did not pay for and have a clear conscience. Obviously somebody is out the money, be it the consumer or the company. I also cannot speak for other states but in Illinois it is against the law it is called Theft of Lost or Mislaid Property.

Ok. Ebay said no record of this. And Paypal said there was no money taken out of my account but there is a watch on my account and if it should come through they will deny the charge and contact me.
Wow! all that and now I feel better.

When I bought my Miller welder the company sent two. When I called them to let them know, they said they may not have caught it. No way I was having that on my conscience. They sent a call ticket and picked the 2nd one up.

I had a similar situation, one of our great sponsors shipped me 2 sets of stainless headers. I gave him a call, he sent me a call tag and back they went. I like good Karma!

The way I look at it as it was a mistake on someones part. Van something that expensive could probably cost someone there job! Good for you!

It had his name on it, so legally, it was his. However, he was the better person and sent it back.

White's Performance is local to me. 5 mins from my house. Good deed you done but they wouldn't have done the same for you. They use to do a lot of race engines for local racers but have almost went exclusively to selling knock off parts and Ebay. Machine shop is all but gone now.

So she said they will send a recall tag and pick this up tomorrow between 8 am and 6 pm. Well done. I had a similar experience (well, actually, a series of similar experiences). Over a period of about six months, I had the following turn up at the house even though I hadn't ordered them:

ATS LSX motor mounts
ATS AFX tall spindles with A-body steering arms
Electric Life F-body power window motors

Like you, I returned all of them... but I *really* wanted to keep the spindles.

There used to be companies sending items to people then harassing them into paying for items they received yet never ordered. So it was established that if you recieved something you legitimately NEVER ordered or asked for you are not obligated to pay for it and CAN keep it, free of charge. And I do believe its a federal statute.
The point was when people were forcing people to take items, the people may not have the money to pay for it were they responsible for paying for it. The courts and I do believe lawmakers put there foot down and said no.
If we sent 10 sets of pistons and forced you to pay for them would this be right, no. But if you order them then dont pay,,,big difference.
It also came from a lot of the companies sending CDs/tapes/dvds/etc then asking for payment or face prosecution.
Now on big stuff, like this one, and sent to wrong NAME and a guy being honest calls back and sends back, hey how a few free good karma boost points!
BUT the laws state if he didnt order it technically he doesnt have to pay for nor return it IF it was delivered to his address/name. And since it had a number associated with him on it, he could technically keep it. now if it was delivered to Bob Doe instead of Bob Dough then there are things like it was simply put in wrong box and you need to return it.
But with proper identifiers its not stealing per se, but if your not honest enough to try and return things, then maybe karma will bite you later.

Each state IS different:

Here is Illinois law:

Illinois Compiled Statutes
ILCS Listing Public Acts Search Guide Disclaimer
Information maintained by the Legislative Reference Bureau
Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process. Recent laws may not yet be included in the ILCS database, but they are found on this site as Public Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the Guide.
Because the statute database is maintained primarily for legislative drafting purposes, statutory changes are sometimes included in the statute database before they take effect. If the source note at the end of a Section of the statutes includes a Public Act that has not yet taken effect, the version of the law that is currently in effect may have already been removed from the database and you should refer to that Public Act to see the changes made to the current law.

(720 ILCS 5/16‑2) (from Ch. 38, par. 16‑2)
Sec. 16‑2. Theft of lost or mislaid property. A person commits theft of lost or mislaid property when he or she obtains control over the property and:
(a) Knows or learns the identity of the owner or knows, or is aware of, or learns of a reasonable method of identifying the owner, and
(b) Fails to take reasonable measures to restore the property to the owner, and
(c) Intends to deprive the owner permanently of the use or benefit of the property.
(d) Sentence.
Theft of lost or mislaid property where:
(1) the value does not exceed $500 is a Class B

misdemeanor;
(2) the value exceeds $500 but does not exceed

$10,000 is a Class A misdemeanor; and
(3) the value exceeds $10,000 is a Class 4 felony.
(Source: P.A. 97‑597, eff. 1‑1‑12.)

The original poster certainly did the correct thing in trying to find out why it was dropped at his home.

Illinois law makes it the responsibility of the person who received the property to find the owner of the property. I'll bet that's a tough case for UPS or anyone else for that matter to prosecute. Just because the item was left on your doorstep does not mean you (property owner where the package was left) took physical possession of the property and therefore have any responsibility to find the true owner. Lot's of UPS shipments left on doorsteps by driver's are stolen by parties other than the resident on who's doorstep the package was left. There are Federal Interstate Commerce statutes that also cover this issue that will "Trump" state law.

Conscience is a personal issue. Personally I would find out who sent the package and send it back. Others would keep the items without a second thought. A lot of this depends upon where you live (state law) and whether you listen to your legal conscience, your moral conscience or both? In today's "It's all about me World" returning an item to the sender that was not ordered is probably RARE. If people can steal from the government and their neighbors without any conscience keeping a windfall package on the doorstep is an easy decision for many!

Interesting... a friend recently bought one of their stroker SBC motors off ebay and had it dynoed by them... it was a great price for sure... hoping it holds up for him.... are they not doing any of their own machine work / assmbly?
