Have a vendor in my state that will not ship parts that are already paid for... about $2000 outstanding parts. What would be the correct way to handle this and protect my intrests?
Anybody know some guys in new jersey that "handle" stuff? :injured:
how long ago did you pay and did you pay by CC? Do a charge back if you paid recently and used a CC. How long has it been since they were supposed to ship? Are you certain he's trying to screw you and isn't simply waiting on the parts to show up?

Picked up parts in person, check written to cover parts he had and paid for parts he didnt...to order. This has been an ongoing issue for about 3 or 4 months. The parts vary from engine to chassis so being out of stock on all or waiting on all is unlikely. Guess I should have done more DD on him ...several bad posts on his biz ...

I was in good faith trying to let the guy complete the deal. So much for that , guess I'll have to drive out there and pay a visit.

Maybe bring Joey "Bag a donuts" with you when you do.
Only thing I can think is to go there with friends if you go at all. The friends are there to corroborate anything that happens. Do not go there looking for a fight. Not saying that you are but without friends it's his word against yours as to what went on. I'd say you can;t trust this guy anymore and need to cover your own a$$ as much as possible from here on out. With it being a check I don't think you have any recourse like a charge back. Small claims court is usually worthless since judgments don't force him to pay you. Check your state laws though, maybe you can. I don't know since you wrote a check. Good luck with it though. let us know how it goes and let us know who this guy is so no one else looses money to him.

How about small claims court? It's hardly worthless. It's cheap, in some states you can file online, and if he doesn't show, you win automatically and can have the judge/sheriff put a lock on his accounts and cash register until you get paid.
Best of all, it's completely legal. Judgments may not force him to pay you, but you have plenty of time to collect, the outstanding amount owed accrues interest until you get paid, and the judgment stays on record, which can be a hindrance for him.
But don't try to "handle" it, as an assault / terrorist threat / extortion / etc. charge will cost a lot more than $2k to defend in court.
Have him served with a small claims court claim. If he pays up, you can always drop the case, and bringing the law into play frequently makes people quit screwing around.
