My 71 challenger project has been cancelled, someone came in and bought the car right out from underneath me. The owner originally sold me the car but gave the deposit back before the title was transferred. I should take legal action but I cant because of my upcoming deployment. So that leaves me in search of yet something else to work on driving before I leave for Iraq. If you know of anything shoot me a line im in NEPA. thanks

That sucks. Hope you find something. As for the legal side of what he did. I am not sure he could do that legally.

Did you have a bill of sale? Was the car in your possession?
Either way it does not matter if the car is already gone. That sucks! Chances are the other guy just offered him more cash. Don't sweat it, Karma has a way of balancing things out.

I didnt get a bill of sale just a reciept for the deposit. Like I said If I wanted to I could take legal action, but If I were to have an open trial I will not be allowed to leave for Iraq, so thats out. I didnt loose any money on this I just lost yet another of my dream cars. However, where I lost one I intend to find another. I have about 7000 to spend initially, im trying to find something that doent need alot of work just something I can put some money into and drive over teh summer. The offer still stands that if you help me find a car and I buy it there is a finders reward.

I don't need a finder's fee but I know where there's an all original cream yellow Barracuda. I thought it had been sold but yesterday it was sitting in the parking lot near where I work with a For Sale sign on it. Last Fall the sign said $10k but who knows, maybe the price has come down some. If you want, next time I see it I'll stop and get the number and current price.

1971 Super Bee, real factory big block 4-speed. Car has non-numbers matching 4-speed in it but no engine. Car ran and drove until engine was pulled recently. One of 766 built in 71, last year of the Super Bee, only year on the charger platform. Needs restoration. This is a perfect time to always make sure that you get an email, fax or some other type of written agreement with a description of the car (VIN number) you have agreed to purchase that says that the seller agree's to sell you (your name and location) the car at a stated price BEFORE you send a deposit.
Include in the agreement the sellers acceptance of the deposit constitutes a binding sale and you the buyer has X amount of time to make full payment and/or pickup the car in person or via shipping.
Without that, the seller could say you just sent him money because he was a nice guy instead of the true reason you sent the seller money. You never know anymore when you send money with no written agreement.
If you make your deposit over $500.00 in most states and the seller tries to screw you, the seller may be commiting Felony Fraud. $500.00 in most states is the dollar amount the constitutes Felony fraud (criminal charge) versuse a civil charge. ALWAYS get a written agreement of some type before sending a deposit. A seller's tune will quickly change if and when he finds out the you have/will file Felony fraud charges. This is a criminal charge, not a civil charge. Big difference!
