View Full Version : Just got arrested
I was in another town parting with my little brother and got arrested for urinating next to a public street. I didn't know it at the time but the bar we were at was across the street from the police department. The bar was closing and they asked us to leave I asked the bouncer or who ever he was very politely to use the restroom before leaving he told me to use the parking lot. I was arrested after doing my business in the parking lot like I was instructed. I have never been arrested before and have a clean record except for driving infractions.
I hate small town cops!
My brother was sober and had not had anything to drink all night he was the DD. Cost me $100 to bond out.
Did i mention I hate small town cops!
Sorry just venting I will probably have to get a lawyer to get it cleared so I can keep my job, since we have clients in that town.

I hope he at least let you finish.
You might not have to lawyer-up. In NY it is only a violation (appearance ticket no real record after conviction). Good luck with you case!
I was done when he approached me. He said it was a civil offense, what ever that is.

Same as NY, not criminal, almost akin to a parking ticket.

On the plus side, at least you're not in CA, where urinating in public can be charged as as "indecent exposure" and you can end up on the sex offender registry / website for life.
(CA really needs to better distinguish between beer drinkers and child molesters.)

I lived next to a bar many years ago and it made me mad when drunks pissed and puked in my yard. The smell of stagnant puddled urine was over whelming in the summer. Its a good law.

I woundn't arrest on it but it is a $150 fine when I take the time to be a pecker checker. Sucks that they hooked you though. I agree, small towns have their own way of dealing with the"rift raf" as they put it.

like bigvegan said, thank your lucky stars you are not here in CA or you could be registering as a "sex offender" depending on how you were charged.
That was the first thing I asked about when I was cuffed. I would not have had a problem with a ticket, but arrested is a Little too much. I will probably get out of it since he didn't read me my rights and my brother can attest to that.

The officer doesn't have to read you your rights.....unless you are questioned. Since the officer probably watched as you were goin, no questioning is needed. It's a crime here in Oregon too.......
Find a better spot to do your business than a parking lot......nobody likes steppin in a another guys mess

True. From wiki
"However, police are only required to warn an individual whom they intend to subject to custodial interrogation at the police station, in a police vehicle or when detained. Arrests can occur without questioning and without the Miranda warning — although if the police do change their mind and decide to interrogate the suspect, the warning must then be given."

This is true. I very rarely read rights on anything except felonies. Plus, how are you going to get out of it? You already got hooked and booked. No getting that back.

Now we all know how to setup the people in power and see how it falls then. Some of these laws need to be better thought out or we will all be in jail !!!!!
Repeal some of this nonsense and stop making laws that just repeat another law thinking that making a specific law will make it easier to enforce. Or at least make amendments that bring back common sense and give reasoning to why we call them Judges in the first place.

I agree, there are some stupid laws.
The one I hate the most is the 21 year old drinking age, all that stupid law did was get a bunch of 18-21 year olds police records.
Kids 18-21 will find a way to drink if they want. When I grew up the law was 18 for beer and wine, 21 for liquor. That seemed reasonable to me back then.
You can vote, serve in the army, marry, have kids, drive, etc... but you can't have a beer? That's stupid. :screwy:

I work in a town here in So. Cal. and it is known for its bars and nightlife. I get a lot of drunks peeing in public, puking, fighting and drunk driving. On the peeing in public, it depends on the guys/girls attitude if they get a ticket. Yes, I have seen several chicks pee on the side of the street after the bars are closed. I usually always give them a ticket since they think they can get out of everything. Guys I give them a break, heck, I have to pee in the middle of the night while on patrol and there are not a lot of places open, kind of a double standard? Anyways, it is a citation and a minimal fine and that is it for us. Of course, I always let them keep the pen when they are done with the signature...don't want that one back! Good luck with your ticket, try and get just a fine and call it one expensive night.

Buddy got aressted in New Orleans for pissing in a ally, first thing they did was take there wallets, had to have his wife get back from the cops, it was during Mardi Gras but he was the for a football game, it happens but its petty, the bad part about it everone has to do it,
I spoke to the city clerk this week. It is not a big deal, it is a city ordinance violation which is less than a misdemeanor on my record. The fine is $74.50 and I paid a $100 bond to get out, that goes toward the fine. The city will owe me 25.50 as soon as I go sign the paper work.
