Last night my wife was rearended on the way home from work. Of coarse the f-ing a-hole punk bailed off of an exit that was right there. The good news is someone saw it happen and got the plate number and gave it to my wife so we have his dumba$$. My guess is that he does not have any insurance and that is why he bailed.

I have not seen the car yet since I am out of town now. I will see it on Thurs. It sounds like the bumber and a little right rear quarter damage. I am sure it will be a few grand if they bent the quarter good enough. When she called the insurance company they said that we had to pay the deductable. I would not have a problem with that if this were a claim on our collision insuance. However, this would not be. We have his information and the car was not reported stolen so I think this was his car. Would this not be on his insurance even if he left the accident site. If he does not have insurance then this would be a claim on the under-uninsured coverage we have on her car? I need to check the policy when I get home, but is there a deductable responsibilty on our end with a underinsured claim? I would think not. If so I guess I need to sue the punk as well.

CALL THE POLICE AND FILE THE REPORT! I got screwed in my 70 Chevelle by not calling the police and getting a report. Even if you pay the deductible, when he is prosecuted you should be reimbursed I think. You also might save somebodies baby in the next hit and run the a-hole gets into. Save a life and make him pay.

I forgot the add that. She did get the police involved. That is why I am not worried on finding this clown or at least the owner of the car.

Coming from an ex-insurance adjuster: There are some policies out there with no-fault coverage without a deductible, but most policies nowdays require that a deductible be met by the policy holder if any claim is made against their policy. No-fault or not. Your options are: File on your own policy-pay the deductible-send the claim # from your insurance company along with a copy of your declaration page (the page that shows your amount of coverage and deductibles) to the other parties insurance carrier. They will re-imburse you for the deductible (as long as his coverage is still good.) IF he does have coverage, and you still decide to file on your personal policy, you can still file a rental claim with the other parties carrier. Your second option is to not file on your policy and hope that you can track the other party down, hope that they do have coverage, and hope that the coverage is sufficient to cover the damage. This will significantly delay getting your wifes car repaired. Nevertheless, good luck with your claim.
